Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services offered by Vioflare ("Company", "we", "us"). By creating an account or using our services, you agree to be bound by these Terms.

1. Agreement to Terms

By accessing our website or using our services you confirm that you are at least 18 years old, have the legal capacity to enter into a binding contract, and have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. Services

Vioflare provides web hosting, domain registration, VPS hosting, email hosting, SSL certificates, and related managed services ("Services"). We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice.

• Services are provided on a subscription basis and renewed automatically unless cancelled.
• We do not guarantee specific features will remain unchanged; however, material changes will be communicated in advance.
• Reselling our services is permitted only under an explicit written Reseller Agreement.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate, current, and complete registration information.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.
• Each person or entity may hold only one account unless expressly authorised by us.

4. Payments & Billing

• All fees are billed in advance for the selected billing cycle (monthly, annual, etc.).
• Invoices are due upon issuance. Accounts with unpaid invoices exceeding 14 days may be suspended.
• We accept major credit cards, PayPal, and bank transfer where available.
• Refunds: Hosting plans are eligible for a full refund within 30 days of the initial purchase. Renewals, domain registrations, SSL certificates, and add-on services are non-refundable.
• We reserve the right to change pricing with 30 days' written notice.
• Prices are exclusive of applicable taxes unless stated otherwise.

5. Acceptable Use Policy

You agree not to use our services to:

• Host, transmit, or distribute illegal content including child sexual abuse material (CSAM).
• Conduct phishing, spamming, or unsolicited bulk email campaigns.
• Launch DDoS attacks, port scans, or other network intrusion activities.
• Host malware, ransomware, botnets, or command-and-control servers.
• Infringe upon third-party intellectual property rights.
• Mine cryptocurrency without explicit written authorisation.
• Violate any applicable local, state, national, or international law or regulation.
• Consume excessive resources that adversely affect other customers ("resource abuse").

Violation of this policy may result in immediate account suspension or termination without refund.

6. Domain Names

• Domain registration is subject to the policies of the relevant registry (ICANN, auDA, etc.).
• You are responsible for providing accurate WHOIS registrant data.
• Domain registrations and transfers are non-refundable once processed.
• We are not liable for the loss of a domain due to expiry if auto-renew was disabled.
• Domain disputes must be resolved through ICANN's UDRP process or applicable registry dispute policy.

7. Intellectual Property

All content on the Vioflare website and control panel — including logos, text, graphics, and software — is the property of Vioflare or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission. You retain full ownership of content you upload to our servers.

8. Uptime & Service Level Agreement

We target 99.9% network uptime, excluding scheduled maintenance windows (communicated at least 24 hours in advance). In the event of an outage exceeding our SLA, service credit may be applied to your account upon request. The maximum credit shall not exceed one month of your monthly fee for the affected service.

9. Limitation of Liability

To the maximum extent permitted by law, Vioflare and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the services — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or relating to these Terms or the services shall not exceed the total amount paid by you to us in the three months preceding the event giving rise to the claim.

10. Termination

You may cancel your account at any time via the client portal. Upon cancellation, services will remain active until the end of the current billing period (except in cases of policy violation). We reserve the right to suspend or terminate accounts that violate these Terms without prior notice and without refund.

11. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
